Lightning Athletic Club Participant Waiver and Release of Liability

PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT CONTAINS A WAIVER OF LEGAL RIGHTS AND AN ASSUMPTION OF RISKS. I, the undersigned, voluntarily choose to participate in activities organized by Lightning Athletic Club (“LAC”) and acknowledge, understand, and agree to the following: 1. ASSUMPTION OF RISK I am aware that running, jogging, walking, hiking, strength training, and other related physical activities involved in LAC events, classes, and training sessions may involve significant risks, including, but not limited to, injuries resulting from falls, collisions with other participants, the effects of weather, road and trail conditions, and my own physical condition. I voluntarily assume all such risks, whether known or unknown, inherent or incidental, associated with participating in LAC activities. 2. ACKNOWLEDGEMENT OF PHYSICAL CONDITION I attest that I am physically capable of participating in LAC activities and that I have consulted with a physician, or am choosing to participate at my own risk without such consultation, regarding my ability to safely engage in the physical demands of LAC events. I agree to immediately inform LAC and cease participation if I experience any symptoms, injuries, or health concerns during any event. 3. RELEASE OF LIABILITY In consideration of being permitted to participate in any activity associated with LAC, I hereby release, waive, discharge, and hold harmless Lightning Athletic Club, its organizers, directors, members, employees, volunteers, and any affiliated individuals or entities (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action, present or future, arising out of or connected with my participation in LAC activities, whether caused by the negligence of the Released Parties or otherwise. 4. INDEMNIFICATION I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, expenses, or losses (including reasonable legal fees) arising out of my actions, conduct, or participation in LAC activities. 5. PHOTOGRAPHY AND MEDIA RELEASE I understand that LAC may capture photographs, videos, or other media during events. I grant LAC permission to use my image or likeness in any promotional materials, including social media, without compensation. 6. GOVERNING LAW This Waiver and Release of Liability shall be governed by and interpreted in accordance with the laws of CALIFORNIA. I agree that any dispute arising out of my participation in LAC activities shall be brought exclusively in the courts of CALIFORNIA. 7. HARASSMENT-FREE CLUB RESPONSIBILITY At Lightning Athletic Club, we are committed to creating a safe, supportive, and welcoming environment for all members. Harassment of any kind will not be tolerated. Definition of Harassment: Harassment is defined as any unwanted comments or physical contact that makes another person feel uncomfortable, unsafe, or disrespected. This includes but is not limited to: • Comments or jokes about someone’s appearance, abilities, or personal life. • Unsolicited advances, flirtation, or suggestive behavior. • Physical contact of any kind that is unwelcome or invasive. Zero-Tolerance Policy: If a member violates this policy, the following actions may be taken: 1. An immediate investigation will be conducted. 2. Depending on the severity, the individual may face a verbal warning, suspension, or immediate expulsion from all LAC activities. Reporting Incidents: If you experience or witness harassment, please notify an LAC leader immediately. All reports will be taken seriously and handled with confidentiality and care. Our goal is to foster a community where everyone feels respected, safe, and inspired to grow. By signing this waiver, you acknowledge and agree to abide by this policy. 8. ENTIRE AGREEMENT This document represents the entire agreement regarding liability and assumption of risk between me and LAC and supersedes any previous statements, agreements, or representations related to LAC activities. If any portion of this Waiver is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
